1. Scope of these terms
These Terms of Service govern the use of the Praktikal website, the Praktikal platform, and related services made available by Praktikal Education OÜ.
Praktikal provides a digital teaching and learning platform for creating, delivering, sharing, and assessing educational content. Praktikal may also offer related physical experiment kits, content licences, subscriptions, and other education services.
These terms apply unless a separate agreement, order form, school agreement, or other written commercial arrangement governs a specific service. If such a specific agreement applies, it prevails over these terms to the extent of any conflict.
2. Service provider
The services are provided by:
Praktikal Education OÜ Võru 3a, Tartu, Estonia Registry code: 16229727 VAT number: EE102398843 Email: info@praktikal.ee
3. Acceptance of the terms
By accessing or using Praktikal, you agree to these Terms of Service. If you use Praktikal on behalf of a school, company, or other organisation, you represent that you are authorised to accept these terms on its behalf to the extent applicable to that use.
If you do not agree to these terms, you must not use the relevant service.
4. Accounts and access
Some Praktikal features require a user account. When you create or use an account, you must provide accurate information and keep it up to date.
You are responsible for:
- keeping your login credentials confidential;
- all activity carried out through your account, unless you have reported unauthorised use without undue delay;
- ensuring that your use of the platform is lawful and consistent with these terms.
Praktikal may offer different access methods, including organisation-managed accounts, direct user accounts, or limited-access session participation such as join links or QR-based entry where available for a specific workflow.
5. School and organisation use
If Praktikal is used by a school or other organisation, that customer may manage user access, roles, content access, and service configuration for its teachers, students, staff, or other users.
Where a school or organisation determines how student, teacher, attendance, grading, or other education-related data is used within its own educational activities, that school or organisation remains responsible for its own legal obligations, internal policies, notices, and permissions.
6. Acceptable use
You must not:
- use Praktikal for unlawful, fraudulent, abusive, or misleading purposes;
- interfere with the security, availability, or integrity of the website or platform;
- attempt to gain unauthorised access to accounts, systems, or data;
- upload, transmit, or distribute malicious code or harmful materials;
- infringe Praktikal’s intellectual property rights or the rights of third parties;
- use the services in a way that could damage Praktikal, other users, or the normal operation of the platform.
You remain responsible for content, materials, and data that you upload, publish, submit, or otherwise make available through Praktikal.
7. Educational content and licences
Praktikal and its licensors retain all rights, title, and interest in the website, platform, software, design, branding, and content made available by Praktikal, except where a different ownership position is expressly stated in a separate agreement.
Subject to the applicable subscription, licence, or agreement, Praktikal grants you a limited, non-exclusive, non-transferable right to use the service and the content made available through it for the intended educational or internal business purpose.
You must not copy, resell, redistribute, scrape, reverse engineer, or otherwise exploit Praktikal content or software beyond the rights expressly granted to you.
User-created content remains subject to the rights and permissions applicable between the user, the relevant organisation, and Praktikal’s service features.
8. Experiment kits and physical goods
Praktikal may offer experiment kits or other physical education products. Their availability, scope, delivery terms, pricing, and any product-specific conditions may be governed by a separate quotation, order, sales agreement, or other written arrangement.
Unless expressly agreed otherwise, public website content about kits is informational and does not by itself create a binding sales commitment.
9. Fees, subscriptions, and billing
Certain Praktikal services are paid services. Pricing, licence scope, billing period, renewal logic, seat counts, and payment conditions may depend on the selected plan or the applicable commercial agreement.
If a paid service applies to you, you agree to pay the fees and charges that apply to your subscription, order, or contract. Payment processing may be handled by third-party providers.
Unless otherwise stated in a specific commercial agreement or required by law, fees already paid are non-refundable.
10. Suspension and termination
Praktikal may suspend or restrict access to the services, or terminate an account or service relationship, if:
- these terms or an applicable agreement are materially breached;
- payment obligations are not met;
- continued access would create a security, legal, or operational risk;
- Praktikal is required to do so by law or competent authority.
You may stop using the service at any time. Where an organisation controls your access, account closure or continued availability may also depend on that organisation’s relationship with Praktikal.
Termination does not affect rights or obligations that by their nature should continue, including payment obligations already due, intellectual property protections, confidentiality expectations, liability limitations, and dispute resolution provisions.
11. Availability, changes, and disclaimers
Praktikal works to keep the website and platform available, secure, and useful, but does not guarantee uninterrupted or error-free operation at all times.
Praktikal may update, improve, modify, suspend, or discontinue parts of the services from time to time, including features, integrations, or content availability.
To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis, except to the extent that a specific written agreement states otherwise.
12. Liability
Nothing in these terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
To the maximum extent permitted by law, Praktikal is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, goodwill, data, or business opportunity arising out of or in connection with the use of the services.
Where Praktikal provides physical experiment kits, any product-specific liability is subject to the applicable sale or supply arrangement and mandatory law.
13. Changes to these terms
Praktikal may update these Terms of Service from time to time. The updated version will be published on this page together with the revised update date.
If you continue to use the relevant service after updated terms take effect, we will treat that continued use as acceptance of the updated terms to the extent permitted by law.
14. Governing law and disputes
These terms are governed by the laws of the Republic of Estonia, unless mandatory law requires otherwise.
The parties will first seek to resolve disputes through negotiations. If that does not succeed, disputes will be submitted to the competent court in Estonia, unless mandatory consumer protection or other mandatory jurisdiction rules require otherwise.
